Terms of Use

These terms are an agreement between you and Okafor Labs ("we", "us") about your use of Tallyho (the "app"). By downloading or using the app, you agree to them. If you do not agree, do not use the app.

Using the app

We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own personal use, in line with these terms and the rules of the store you got it from.

You agree not to:

• copy, modify, or redistribute the app, or try to extract its source code, except where the law allows it;
• use the app to break the law or to infringe anyone's rights;
• interfere with the app or its servers, probe them for vulnerabilities without permission, or access them by automated means we have not allowed;
• use the app to send spam, malware, or content that harasses or harms others.

Purchases and subscriptions

Some features need a paid subscription or one-time purchase. Prices are shown in the app before you buy.

• Payment is handled by the Apple App Store or Google Play, under their terms. We never see your card details.
• Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You are charged for the renewal within the 24 hours before the period ends.
• Cancelling: manage or cancel subscriptions in your App Store or Google Play account settings. Deleting the app or your account does not cancel a subscription.
• Free trials: if offered, any unused part of a trial is forfeited when you buy a subscription.
• Refunds are handled by Apple or Google under their refund policies. We cannot issue refunds for store purchases ourselves.

Our content and trademarks

The app, including its design, text, graphics, and code, belongs to Okafor Labs or its licensors and is protected by law. These terms do not give you any right to use our name, logo, or trademarks.

If you send us feedback or ideas, we may use them without any obligation to you.

Third-party services

The app may link to or use services run by others, such as the App Store, Google Play, iCloud and Google Drive. Those services have their own terms and privacy policies, and we are not responsible for them.

Privacy

Our Privacy Policy explains how we handle your information.

Changes and availability

We may update the app, change or remove features, or stop offering it. We may update these terms. If a change is significant, we will tell you in the app or by email before it takes effect. If you keep using the app after that, you accept the new terms.

Ending this agreement

You can stop using the app at any time. We may suspend or end your access if you seriously or repeatedly break these terms, or if we have to for legal reasons. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability) continue to apply.

Disclaimers

The app is provided "as is" and "as available". To the extent the law allows, we make no warranties of any kind, express or implied, including that the app will be error-free, uninterrupted, or fit for a particular purpose. Keep your own backups of anything important.

Limitation of liability

To the extent the law allows, Okafor Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising from your use of the app. Our total liability for any claim relating to the app is limited to the greater of the amount you paid us for the app in the 12 months before the claim and USD 50.

Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud. If you are a consumer in the EU or UK, you keep all the rights you have under mandatory consumer law.

Apple App Store

If you got the app from the Apple App Store:

• These terms are between you and Okafor Labs only, not Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
• Apple is not responsible for handling any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection claims.
• If a third party claims the app infringes their intellectual property, Okafor Labs, not Apple, is responsible for investigating, defending, and settling the claim.
• You confirm that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law

These terms are governed by the laws of Portugal, without regard to its conflict-of-law rules. Disputes will be handled by the courts of Lisbon, unless the law where you live gives you the right to bring a claim in your local courts.
